"Divorcing Couple Argue Over their Mortgage Broker"

 I have been in the mortgage business a long time and have never been put to this test. I had done mortgages for this couple over 20 years and now that they were getting divorced they wanted me to handle a mortgage for them, but they decided I could only represent one of them and I had to make the choice. Are you kidding me?  

Initially I got a call from the husband putting me on notice that he was moving and was going to buy a home, with his girlfriend and wanted me to handle the mortgage. OK, no problem and then told me I couldn't do the wife’s refinance. You’re kidding right? No, not kidding at all.  

I then got a call from the wife requesting that I handle her refinance. I told her that I received a call from her husband earlier in the day. She was pissed and told me that they had discussed having me do the refinance and he would get someone else. She went on to say, that I will have to make the decision.  

I asked who her attorney was and who was representing her in the divorce and then asked permission to speak to attorney about this issue, she said fine.  

I then called the husband and asked to speak to his attorney about the representation issue, reluctantly he shared the name. Fortunately I had worked with both attorneys in the past.  

I ended up speaking to both attorneys to see if I could convince them to allow me to represent both parties. It turned out one of the attorneys had objected to having me representing both of them, as it was a conflict. I asked him to explain what the conflict would be. He raised a number of things, none of which really had any merit, so I addressed his concerns. Both of them said they would discuss the possibility I could handle both mortgages.  

Finally a meeting of the minds and both parties agreed to have me do their mortgages. This was a new one for me. Hope they keep me out of the drama and allow me to do what I do best.
