Appeal of Proposed Spencer Street Walmart Location to be Heard in October

The hearing is set for Oct. 30, 2013, in a Hartford courtroom.

A Hartford appellate court will hear an appeal that seeks to block the construction of a second Manchester Walmart location on Spencer Street in October of this year. 

According to court documents, Judge Marshall Berger will hear the case at 10 p.m. on October 30, 2013 in Hartford.

The appeal, filed by the local ShopRite on Spencer Street across the street from the proposed Walmart, seeks to overturn a special exemption granted by the Planning and Zoning Commission on Jan. 7, 2013 to allow the construction of a 158,420-square foot Walmart supercenter at 205 Spencer St.

The Manchester Planning and Zoning Commission and Walmart are both named in the complaint, filed by Marjorie Shansky, a New Haven-based attorney, on behalf of Waverly Markets, LLC., the local ShopRite's parent company.
